Listens, but sometimes talks too much. Rarely argues. Usually considers all views.

Listens and speaks a fair amount. Never argues with other side. Always tries to reach a fair decision.

Makes very weak arguments or no arguments; doesn't analyze the case at all.

Makes some arguments for the assigned side; simple analysis used.

Makes good arguments for the assigned side; more complicated analysis.

Makes great arguments for the assigned side; uses analysis that is complicated and takes the facts into consideration.
Mediation

During mediation of the matter - makes no effort to resolve the issues. Makes mediation impossible.
Average

During mediation of the matter - makes little effort to resolve the issues. Makes mediation difficult.
Proficient

During mediation of the matter - makes more of an effort to resolve the issues and makes somewhat relevant and good suggestions as to how that can be accomplished.
Outstanding

During mediation of the matter - makes great effort to resolve the issues and makes relevant and great suggestions as to how that can be accomplished.
